Port Royale Rules

PORT ROYALE HOMEOWNERS ASSOCIATION RULES

Recreational Facilities

Quiet time from 11:00 P.M. to 8:00 A.M.

Swimming pool facilities are for the use of Port Royale owners and their guests only.

There are NO lifeguards on duty. Your use of the pool area is at your own risk.

No diving

No glass containers or kegs are permitted in the pool area. All liter must be placed in the proper receptacles.

Running in the pool area is not permitted. Any type of "horseplay" is  prohibited.

Absolutely no consumption of alcoholic beverages by minors is allowed.

Only swim wear is allowed in the pool.

No children under 12 permitted in the pool area without an adult present.

No pets in the pool area.

Pool furniture must remain in pool area and ON pool deck.

No skate boards or roll blades allowed in complex.

Docks and Boat Launch Facilities

Swimming is allowed at the deep-end of the dock. Swimmers and boaters alike should use caution in this area because of joint use,

Each slip owner is expected to keep his area free and clean of any item or debris.

No running on any dock or dock ramp.

You are responsible for cleaning-up any area in which you clean fish.

"No Wake" speed is mandatory within 100 feet of docks.

Boats which do not comply with the Missouri State noise control ordinance, are asked to switch to quiet within 500 feet of dock area.

All slips are private. Do not use any dock slip without permission of the owner.

NO excessive noise or loud conduct allowed in the dock area.

No overhead storage of equipment is allowed.

Any child on or near the dock, under the age of 7, must wear a personal floatation device at all times.

One dock storage locker per dock slip. It shall be a size and design approved by the board. It must be installed on the shore line side.

No sub-lease of slips to non-owners.

Boat owners may not allow bow to extend over walkway where injury may occur.

Dock utility service is for the exclusive use of owners. Any owners who requires additional service will be responsible for securing approval from the board and the costs associated with the upgrades.

Absolutely no fuel is to be carried on the docks or used at the dock area at any time.

Interior Changes or Modifications

All owners when leaving their unit unoccupied must, if possible, shut off the water supply to the unit; shut off the ice maker; and, turn off the electrical supply to the water heater. During cold weather keep the heater set at a minimum of 55degrees. Damages that my occur to the common elements and/or individual units as a result of unit owner’s failure (or negligence) to adhere to winterization guideline shall remain the personal responsibility of such owner and owner’s insurance.

All units are required to have window coverings on all windows except patio doors. All window coverings must be backed with a material that is white in order to maintain a uniform appearance throughout the complex.

Short term rentals are not allowed.

No operation of a business on the premise.

"For Sale" signs are limited to 3'x3' in size and are to be displayed on parking lot side only.

General

The Port Royale Association Board reserves the right to amend these rules from time to time.

The rights and privileges of Port Royale Association Board are extended only to members in good standing who have paid all dues and assessments.

Quarterly assessments/dues for condominium units and, where appropriate,(other items) assessments, are due and payable on the first day of each quarter with a ten day grace period before late charges apply.

After the 10th day of the month of said unpaid assessment, there will be $15 late charge assessed. Beginning the same day there will be a 1.5% per month interest charge on all unpaid assessment, penalties and fines.

The Association prohibits noxious or offensive activities, which annoy or become a nuisance to other property owners, or otherwise interfere with the right of "quiet enjoyment."

Any exterior modifications must be approved in writing by board.

Courtesy and good judgment must be used in controlling excessive noise and inappropriate language. Use of amplified sound devices such as, but not limited to, televisions, boom boxes and PA systems, at high enough levels to disturb the peace and tranquility of neighbors, is prohibited. Please observe quiet hours from 11 p.m. to 8 a.m..

The violation of any rule or regulation adopted by the Board, or the breach of any Bylaw, shall give the Board or the Managing Agent the right, in addition to any other rights set forth herein, (1) to summarily abate and remove, at the expense of the defaulting Member, any person, structure thing or condition that may exist within the facilities contrary to the intent and meaning of the provisions thereof, and to expel, remove and put out, using such forms as may be necessary in so abate or remedy by appropriate legal proceedings, either at law or in equity, the continuance of any breach, to levy and collect fines as outlined in the associations Declaration of Restrictive Covenants, Declaration of Condominium and/or Bylaws. Failure to enforce any provision of these Bylaws or amendments thereto shall in no event be deemed a waiver of the right to do so thereafter.

All unit owners must maintain appropriate property and personal insurance at all times related to their condominium ownership. Owners must request that insurance agency send a certificate of insurance to Association’s managing agent.

Common Areas

It is the owner’s responsibility to control their children or their guests’ children while on property. There shall be no climbing or playing on entries, stairs, railings, fences, ladders, etc. on the property. Ball or throwing-object type play, skateboarding or like activities is not allowed on sidewalks or in the parking area.

The speed limit within the association is 10 MPH.

Each owner is responsible for providing one key to management or it’s designated agent, which will be kept secure, for emergencies, pest control, and checking thermostat.

Use caution when using outdoor gas grills by keeping them away from the building and or railings.

Stairs, landings, stair steps and other common property including front porches may not be used for storage of bicycles, grills, firewood, flowerpots, patio furniture or other personal property. No hanging or draping of clothing or other articles from these areas or limited common use areas is allowed.

The general appearance and cleanliness or all outside decks is the responsibility of each unit owner and/ or his guests. Care should be exercised when washing down or sweeping to prevent debris from littering decks or your neighbors below

No littering of any kind, including any smoking material, is permitted. All trash and or garbage must be bagged and placed in proper receptacles. Any oversized or hazardous refuse must be removed from the property at the owners expense.

Storage of gasoline, kerosene, oil or other flammable liquids within the units, on entrance decks or on docks is strictly prohibited.

The throwing or launching of any projectiles in the complex is prohibited. This includes but is not limited to stones, rocks and water balloons.

Use of fireworks or firearms within Port Royale boundaries and docks is strictly prohibited.

Only one decorative plaque or ornament, four square feet or less in size, may be displayed on the outside wall of the primary entrance side of the unit.

The owner, guest of owner may use open parking spaces, for the parking of automobiles. Storage or parking of boats, personal water craft, and any type of trailers, campers, motor homes, recreational or commercial vehicles is prohibited. Any of the above parked on Port Royal property are subject to removal at the owner’s expense.

No storage of any items is allowed on any Port Royale common area. Temporary trailer storage is allowed on the top of the hill for a period not to exceed one week.

Any changes or additions made to the exterior of a unit, whether common area or limited common area, must have written approval from the Board. Said areas include, but are not limited to courtyards, stairs, landings, walkways, steps, screened in porches, exterior windows and walls. All requests must be submitted in writing.
